Zoning Board of Adjustment Minutes

April 9, 2008
6:30 pm meeting opened.

Members present: E. Younkins, B. Lucas, G. Perham, J. Ingerson,
Selectman:  J. Reid (absent)
Administrative Assistant: B. Menchin
Public: Mr. & Mrs. Steve Jesseman, Mr. & Mrs. Brian Higgins, Thaddeus Presby, Mr. Randy Towns, Mr. Towns (father), Mr. Towns (brother), Mr. Gerry Gallick (Horizons Engineering), Mary Dougherty (Peabody & Smith Realty)

PUBLIC HEARING:  Applicant Randy Towns of All Metal Recycle, of Hardwick, VT, requests a Special Exception concerning Article V Section 5.07.7.  Applicant requests a special Exception to use an existing truck garage for a proposed metal recycling center.  Property is located at 81 Canelas Drive,

Mr. Towns started the hearing by describing the physical characteristics of the site.  He stated he would like to ad a truck scale and place a concrete pad on the property where the metals would be dropped onto.  He described the type of recycling operation he would have and how the metals would be disbursed.  He stated he would not be storing parts on the premises.  He would be separating everything that comes onto the site and the it would be disbursed in a short period of time (approximately 1 week’s time).  

GP asked how many cars are delivered in Hardwick, Vt.  Mr. Towns stated that in the summertime the business would receive about 20 cars per day.  He would have 10 to 12 cars outside and 3 cars would be loaded at one time onto the trailers.  He would strip the vehicles in the garage.  Mr. Towns further stated that his operation in Vermont takes 4 to 5 trailers per day.  He stated he did not feel as if it would be that busy at this new location.  Mr. Towns stated he would use a bucket loader and an excavator to maneuver the car bodies.  The excavator would crush the car bodies.  GP asked if Mr. Towns would have any problem with the Board coming to visit their operation in Vermont.  Mr. Towns stated he would absolutely enjoy a visit from the Board.  

Mr. Towns stated that his hours of operation would be up to the town, he would comply with anything they requested.  

The question of noise came up.  Mrs. Higgins stated that she did not feel as if the existing trees would be a buffer for the noise.  

Mr. Towns stated he would be getting his Green Yards certification from the Department of Environment Services.  Mr. Towns further stated that no cars would be moved from Hardwick location onto the Lisbon site.  

Regarding the driveway, the State assumed it would be wide enough for entry as the existing business had large trucks entering and leaving the site.  Mr. Towns stated that if that were an issue, he would have no problem correcting the access.  

Mr. Towns stated he wanted to be a good neighbor and would do whatever it took to comply.  He further stated that in the beginning he would be hiring 2 local people for full-time jobs.

The Board asked if there were any abutters who would like to speak.  Mr. Steve Jesseman of the KOA Campground spoke.  He had submitted a letter to the Board voicing his objection to this operation.  Mr. Jesseman felt as if the noise of the operation would be intolerable and would badly damage his business.  Mr. Jesseman further stated that the noise from when Mr. Canelas was there was loud and the noise from the gravel pit operation across the river is disturbing to his business.  Mr. Jesseman stated that his most expensive lots for rent were directly across the street from the entry to this property.  

Mr. Towns suggested he could adjust his hours to help accommodate Mr. Jesseman’s business but Mr. Jesseman stated nothing could be done.  BM asked if there was anything he felt could happen so that the town could allow this business on that property and he stated “no”.

Mrs. Brian Higgins asked if this operation were to be granted, would the Towns’s plan on closing the snowmobile trail behind the property.  

After all conversation Mr. Towns stated that he and his brothers want to be good neighbors and very much would like to be in the Town of Lisbon.

GP before the vote stated he wanted to commend the composure of all parties.  EY stated that he too felt that every party involved with this hearing should be commended.  He further stated that he and GP had been on the site and did confer that Mr. Jesseman’s business could possibly hear the vehicles going in and out.  

GP made a motion and BL 2nd to take a vote.

Minutes were read and approved.
