Zoning Board of Adjustment Minutes

Chairman Younkins opened a public hearing for applicant Edward J. Rasicot on a request for a Special Exception concerning Article V Section 5.07.6. The applicant proposes to add a second dwelling on property located at 1102 Presby Road, also known as Map R13 Lot 16, in the D district, containing approximately 2.82 acres. The application was complete with an attached sketch and abutters were notified by certified mail and an ad announcing the hearing was published in the Caledonian Record. Chris & Tonya Hoyt explained they wished to put a 60’ x 12’ mobile home towards the back of her father’s property. They would get water from an existing well and, due to the time of year, plan to use a holding tank in place of a state approved septic system until spring. They
were reminded that, if the special exception is granted, they still need to file a building permit application and it would be up to the building inspector to determine if a holding tank is allowable as a temporary septic system. They will use the same driveway as the existing home. Mr. & Mrs. Tirrell, the only abutters present, both stated they had no objections to the additional dwelling.
Hearing no further comments or questions from the Board or abutters, chairman Younkins called for a vote to grant the request for a Special Exception to Article V, Section 5.07.6 subject to the following conditions: 1. The dwelling may only be occupied by a family member of the current land owner. 2. A state approved septic system must be installed in the spring of 2006. 3. The dwelling cannot be used as a rental property. 4. Owner will comply with all federal, state and local regulations.

The vote was in the affirmative; all voted in favor. The application for a special exception to Article V Section 5.07.6 is approved with conditions.

Per the Board’s decision at the last meeting, D. Clark advised that a letter was sent to Peter Whitelaw and Karen LaRocco, owners of the Ammonoosuc Inn, regarding the 10’ x 12’ utility shed they placed only 3’ from the Inn and the need for them to either attach it, move it at least 15’ from the Inn, or file an application for a variance to leave it in its current location. She also noted another appeal may be scheduled for January for Sean and Sabra Carroll as they placed their mobile home within 10’ of their rear property line in a district that requires a 25’ setback. The Planning Board will make that determination at their December 21, 2005 meeting.
The minutes of the November 9, 2005 meeting were approved. Motion by S. Derosia, 2nd by B. Lucas, all voted in favor.
