Selectmen’s Meeting Minutes
Meeting Date: May 3, 2010

JN opened the meeting at 4:30 PM
Bills and manifests were approved

BOARD OF SELECTMEN:
The Board received a complaint regarding notification of water hydrant flushing from a person on Jersey Avenue.  The Board requested RP post any future notices onto the Town web site and at the Woodsville Guaranty Bank.

The Board will have a work session on Wednesday, May 5, 2010 at 1:00 pm to finish cleaning the future Planning Board Records Room.

The property on School Street was discussed.  JN made a motion to deed the property.  RAR 2nd, so voted all.

The Board received a complaint via an anonymous letter and requested RP to have Mr. Tanis “Joe” Tavernier (Lisbon Police Department Chief) investigate.

TOWN ADMINISTRATOR:  Regan Pride
RP informed the Board that the Avatar software program for utilities will be installed Tuesday, May 11.

RP submitted a list of values for property owners stating the warrant for the 1st issue 2010 tax bills needs to be signed by May 15.  The bills need to go out no later than June 15 and must be due by July 1.  It was noticed there are still a few corrections to be made prior to having the warrant signed.

RP informed the Board the auditors were in the Town Hall last week.  They will return on May 26, 2010 to complete the town wide audit.  

Mr. John O’Dowd of TD BankNorth has offered to come and sit with the Board regarding the Buffington Fund.

The New Hampshire Municipal Association is looking for input regarding vital budget issues.  

RP told the Board that the Preservation Alliance will be having their annual achievement award ceremony on May 18, 2010.  

RP submitted an email to the Board members regarding an email he received from Ms. Ina Lippard.  In this email, it was stated that Mr. & Mrs. Lippard had a forester look at the pine trees located on their property to see what the value of the trees are.  She was told the estimated cost of removal would be $7,000.00.  In her email to RP, she further stated this does not mean that they were going to allow the trees to be cut.  In the RP’s email to the Board, BM pointed out that he stated BM had corroborated what Ms. Lippard said.  BM stated to the Board that RP must have misunderstood what she told him as she did not corroborate Ms. Lippard’s comments.
RP received a quote for removal of 13 trees in the amount of $5,600.00.  It was noted that the logger who had given the quote to Mr. & Mrs. Lippard did not have the ability to down the trees safely.  

RP further pointed out to the Board there was a power pole in the line of the possible dig sight.  
 
PUBLIC INPUT:  Joseph Ardolino,
Mr. Ardolino spoke to the Board regarding the conversation he had with Mr. Lippard when the logger was on his property quoting the disposal of the trees.  He stated Mr. Lippard told him that the trees would come down on his property.  He further stated that Ms. Lippard was not present during these conversations.  Mr. Ardolino stated he has never told anyone they couldn’t come onto his property and has never declined anything regarding the existing sewer lines.  Mr. Ardolino stated that a friend of Mr. & Mrs. Lippards made a comment that he had just gotten off the phone from a lawyer and that the lawyer stated Mr. & Mrs. Lippard could hold this up for 1 to 1 ½ years.  Mr. Ardolino further stated that he would not lie to anyone as he doesn’t want to remember what he lied about; it is easier to remember the truth.

MC asked Mr. Ardolino if he had ever had any problem with the town coming onto his property to fix the sewer lines.  Mr. Ardolino stated he never had an issue.  He further stated that if the repairs were done on the line he would prefer the town stay on the right-of-way as much as possible and hoped there would be as little damage as possible but knew the town would correct any damage that possibly could occur.  

RP stated he had spoken to Mr. Kevin Clement (Department of Public Works) regarding where the sewer line goes.  Mr. Clement stated he thought the lines may go under the garage and if that were the case, he would want to go around the garage and that would require permission from some land owners.

JN request RP contact Mr. Kevin Schofield to see where the line does in fact go.  

RP further sated that Mr. Clement had said that it might be possible to bore and slide a new line through the existing pipe which then could alleviate any problems with the garage.  It was stated that the roots of the trees could still enter the junction points of the pipes.

RP presented the Board with an outline of various methods that could be done to correct the situation such as fixing the line in place, offset the line onto Mr. Ardolino’s property, a new line on Dickinson Street or sleeve the existing line.  He further had some pro’s and con’s on each individual way to correct the situation.

The Board discussed the fact that the sewer line could not go onto the road as it would be too close to the water lines.  RAR told Mr. Ardolino that the Board would be looking at all of the possible solutions are and which one would be the best for the long term.

MC stated he didn’t think sleeving would hold up.  

Mr. Ardolino stated that if the trees and stumps were gone there would be no blow-downs in that area to contend with.  Mr. Ardolino asked if the person the town spoke with regarding the tree removal was a logger.  MC stated he was a professional commercial landscaper who removes large trees in precarious areas.  Mr. Ardolino further told the Board that two or three trees have already fallen.  He felt as if the trees are in poor condition.

At the end of the conversation, JN thanked Mr. Ardolino for his understanding of the situation and stated the town wants to correct the situation without problems.  Mr. Ardolino stated he has no problems with the town correcting the lines on his property.  

RP stated that Mr. Kevin Clement (Department of Public Works) was not comfortable with entering Mr. & Mrs. Lippard’s property with the no-trespassing signs.  

Mr. Ardolino requested copies of all correspondence that the Board of Selectmen may receive in the future on this matter.  

After Mr. Ardolino left, MC made a motion to execute the easement by prescription to fix the existing sewer line.  JN 2nd, so voted all.

The Board requested RP to send a letter informing the residents on Dickinson Street of the decision and then to certify mail all the residents when the work will begin.    The Board further requested BM to hold the minutes one day prior to release so that the residents would have their decision letter.

MC made a motion to adjourn, RAR 2nd, so voted all.

Meeting adjourned at 7:00 pm.
